State of North Carolina Rutherford County: Court of Pleas & Quarter Sessions October Sessions
A.D. 1832
On this 24th day of October 1832 personally appeared in open Court before the Justices
of the County Court of pleas & quarter sessions for the County of Rutherford now sitting Willis
Weathers a resident in the County of Rutherford State of North Carolina aged 74 years who
being first duly sworn according to law doth on his oath make the following declaration in order
to obtain the benefit of the Act of Congress passed June the 7th 1832.
That he entered the service of the United States under the following named Officers &
served as herein stated.
That he entered the service of the United States in the County of Franklin North Carolina
on the 28th September 1780 as a drafted militia man, under the command of Captain Jenkins
Devaney and Colonel Heart's Regiment afterwards commanded by Colonel Branch under
General Jones -- marched to the Waxhaw in South Carolina & returned & was discharged at
Providence [probably New Providence] in North Carolina & entered the service again in the fall
of 1781 -- in Franklin County NC as a volunteer for the term of twelve months under Captain
John McNees, under General Sumner [Jethro Sumner] & afterwards marched into South
Carolina under Captain Hall [probably, Clement Hall, Junior] in General Green's [sic, Nathanael
Greene's] Army -- & was discharged at Bacon's Bridge in SC.
That he was born in Sussex County in the State of Virginia on the 29th day of March
1759. That he has no record of his age.
That he was living in Franklin County NC when he entered the service. That he lived in
11 years in York District SC & 3 years in Mecklenburg County NC & since that time has lived in
Rutherford County where he now lives which has been upwards of thirty years. That he was
drafted when first called into service & afterwards as a volunteer. He was acquainted with
Colonel Little [probably a reference to Archibald Lytle], Major Dunahoo [sic, Thomas Donoho] -- General Greene, Major Armstrong. That he had a discharge from Captain Hall but has since lost it.

That he is acquainted with Drury Dobbins & John Bennett who can testify as to his character for
veracity & their belief of his services in the revolutionary war.
He hereby relinquishes every claim whatever to a pension or annuity except the present &
declares that his name is not on the pension roll of the agency of any State.

swears that he was acquainted with Willis Weathers & knows of his
entering the service for 12 months as a volunteer, and that he returned after the term of service
expired; that he has good reason to believe he served the other term as stated in his declaration,
& that he has been acquainted with him through life & he has always been esteemed & upright &
truthful individual.

On this 29th day of April A.D. 1833 personally appeared before me William L. Eskridge
an acting Justice of the peace in and for said County Willis Weathers aged seventy-four
years who being duly sworn according to law made the following statement amendatory of the
foregoing declaration in order to obtain the benefit of the act of Congress passed June the 7th
1832. That the service he performed under Captain Jenkins Devaney in the year 1780 as stated in
the foregoing declaration was for the term of 3 months. That he served the term of 3 months
under Captain Devaney & believes it was an omission in the person who wrote the declaration at
the time was not specified before.
